When a new supervisor placed him on disciplinary probation for 90 days, he was told he had to improve his ?video rate? from 8% to 55%. The rate measures how much of an investigator?s time is spent videotaping a target?s activities.

Lorenzo was about 60 days into his probation when he was terminated for poor performance.

He sued, alleging race discrimination. He pointed out that he had already improved his video rate to over 20% when he was suddenly terminated. This, he alleged, was proof that poor performance was a pretext for race discrimination.

The court essentially agreed that cutting the probationary period short while Lorenzo was clearly improving could be evidence of discrimination. It looked like ICS Merrill jumped the gun for fear Lorenzo would meet his goal. Now a jury will decide whether the company was legitimately disciplining Lorenzo?or just looking for an excuse to cover up discrimination. (Lott v. ICS Merrill, No. 11-1704, 6th Cir., 2012)

Final note: The court was also concerned that no policy, rule or handbook actually stated that em??ployees were supposed to maintain a 55% video rate. Lorenzo testified that the first he heard of the rule was when he was placed on probation. No other employees could remember hearing about the rule, either.

The Dow Jones industrial average hit its highest close since the pre-crisis days of November 2007. The Russell 2000 index of smaller companies briefly traded above its all-time closing high.

Markets rallied around the world in places where traders were getting their first chance to react to the Fed announcement: Stocks climbed more than 2 percent in India and France and almost 2 percent in Japan and Germany.

Apple, the most valuable company in American history, blew through its own all-time high and neared $700 per share as it started taking orders for the iPhone 5.

The gains came on top of a 206-point climb for the Dow on Thursday, when the Fed laid out additional plans to try to energize the economy, including buying $40 billion a month in mortgage bonds for as long as necessary.

But a day later, even with the market rising, plenty of investors were unconvinced. They bought stock, but they also worried that the Fed can't do much to fix the economy and predicted that the stock market gains would be short-lived.

Tyler Vernon, chief investment officer of Biltmore Capital in Princeton, N.J., wanted to capitalize on the market euphoria while he could. That the Fed is still taking such aggressive steps to boost the economy, four years after the financial crisis, doesn't give him much comfort.

The Fed, Vernon said, is "like the morphine being pumped into the patient. It keeps the patient walking and talking."

The Dow rose as much as 113 points Friday before pulling back. It ended up 53.51 points to 13,593.37. It is a 4 percent rally away from its all-time high of 14,164, reached Oct. 9, 2007.

The Standard & Poor's 500 rose 5.78 to 1,465.77, almost exactly 1,000 points below its all-time high. The Nasdaq composite index, which has been trading at the highest levels since 2000, climbed 28.12 to 3,183.95.

The Russell, which tracks 2,000 stocks with market values below $5 billion, closed at 854.70, a hair under its all-time high of 865.29 on April 29, 2011. Because the index contains small companies, it is seen as a gauge of investors' risk tolerance.

In the steps it laid out Thursday, the Fed extended its pledge of super-low short-term interest rates into 2015, from its previous target of 2014. Its plan to buy mortgage bonds is part of a strategy known as quantitative easing, designed to get people and businesses to borrow and spend, and to raise stock prices.

To be sure, investors can find other reasons to buy besides the Fed action. Corporate profits are high, and stocks are not expensive by historical standards when compared to earnings.

The psychological effect of the Fed's action is important for the economy as well: If the Fed weren't buttressing the stock market and the Dow were thousands of points lower, consumers would feel less wealthy and cut spending.

But that didn't have everyone convinced that the Fed's moves will make much difference in the end.

Jeff Sica, president and chief investment officer of SICA Wealth Management in Morristown, N.J., was underwhelmed by the Fed's commitment to keep interest rates low. Short-term interest rates have been near zero for years, he noted.

"How many times can you refinance your house?" Sica said.

Dwight Johnston, chief economist of the California and Nevada Credit Union Leagues, expected the stock market gains to be short-lived ? just like they were after other central bank moves, he said.

"The definition of insanity is doing the same thing over and over again and expecting different results," Johnston said. "I think this may qualify."

Data out Friday also underscored the tenuous state of the economy. U.S. industrial production fell in August by the largest amount in more than three years, the Fed reported.

Also, high gas prices drove up consumer prices in August by the most in three years, the Labor Department said. The national average for a gallon of gas is around $3.87, a hardship for many families.

Among other stocks making notable moves:

? The Children's Place clothing store rose $1.85, or 3 percent, to $60.67 after a Citi analyst opened coverage of the company with a "buy" rating.

? The Cracker Barrel restaurant chain slipped $2.04, or 3 percent, to $64.13 after a KeyBanc analyst cut his rating to "hold" from "buy," citing high food costs.

? Staples was up 25 cents, or 2 percent, to $12.21 after Fortune magazine reported that private-equity firms are considering buying the office-supply company.

And they can even expand their database (see the second box called out in orange above) by asking voters to send this survey to a friend.

Bottom line: no risk, no reward. And really, it's not that much of a risk, anyway. The people who give feedback are often those with the strongest feelings -- both negative and positive. So while you may get heated responses from some unhappy people, you'll also get some overwhelmingly loving responses from your ardent fans.

Nothing bad! Who would've thunk it? Not only does this board have a ton of followers ... can you imagine a better way to get insight into the interests of your target audience? This user-generated social media content is a persona-development gold mine!

7) Giving Away Your Secret Sauce

We can't tell people how we do what we do! They'll just do it themselves and we'll go out of business! Lock the doors! Turn off the lights! Burn the documentation!

Alternately, you could remember that sites like Pinterest -- that's right, we're not done with our Pinterest love affair yet -- are perfect for how-to and DIY content. In fact, the pins that consistently gets repinned the most frequently on Pinterest include the word "DIY," according to research conducted by HubSpot social media scientist Dan Zarrella. That shouldn't come as too big of a shock, either, considering "how-to" content typically performs well in every other inbound marketing channel.

That's why we love that Molly Maid isn't shying away from teaching people how to maintain a clean home; they know their target customer is interested in these tips and tricks they can do along the way, but still want the bulk of the work to be left to a professional. This pinboard establishes themselves as an authority in their field, without sacrificing clientele.

8) Taking a Stance on a Controversial Issue

I feel like I'm going to start controversy just by posting this example. But, here's an example of a brand that knew they'd anger some people with their Facebook post ... but went out on a limb and did it anyway:

There were,?of course,?tons of people who said they'd never eat an Oreo again. I don't think it will have a big impact on their bottom line. Nabisco's probably doing just fine. A move like this is certainly a measured PR decision,?and one thing's for sure -- they had a lot of detractors come out.?But there was also a huge, enormous movement of supporters who came out to congratulate Oreo. And a lot of those supporters were new to Oreo's Facebook Page. That's one way to generate reach ... or just stand up for something your company believes in.

9) Posting Content Unrelated to Your Brand

Okay, so this is one of those risks that's a risk because a lot of people think it's a faux pas. I mean, why should you post content that's unrelated to your brand, product, service, or industry? That's what your audience is there to see!

True ... ish. But honestly? Because it was a sign of a social media screw up for a while, people stopped doing it. And then social media profiles turned into these stale, lifeless things that were full of content everyone expected. That's screwing up, too! So what's a marketer to do?

Post intermittent updates that show your brand's personality! It's really, really refreshing. Take a look at this example from custom jewelry designer Jane Font Jewelry Designs, for example:

That's a really cool update to read! Don't you feel like you know the business owner a little better now? And do you notice how she weaved in a fun, controversial topic to get conversation going? Here's another instance ...

It's so easy for brands to become faceless because they're concerned about getting transactions, leads, comments, engagement, blah blah blah. Look, that's all important, but so is just making people feel good. And if you think this whole "having a personality" approach only works for a small business, think again. Here's one more example from luxury car service Uber:

Outer space and rainbows. Zero percent luxury car service tie in. One hundred percent awesome.

10) Showing Up on Pinterest When You Have No Business Being There

Sooo ... vacuum cleaners. They're really pretty, right?

I think there's a few reasons fathers teach their sons to never give their wives cleaning supplies as a gift; and one of them (just one of them, I know there's a thousand more) is probably that they're not really that pretty. People need vaccuum cleaners, they don't sit around ooh-ing and aah-ing about how cute they are. So why would you create a Pinterest account for them?

Well, if you're Oreck, you do it because you thought of ways to make your product visual. Take a look at three of their pinboards that focus on aesthetically pleasing things ... and note the vacuum cleaner tie-in in the board descriptions! This one even has a fun little rhyme going with "Blue, it's our longtime obsession. Blue, it's not even a question."

So if you think pinners are going to throw your brand out on its toosh if you show up on Pinterest, think again. They'll only rail against you if you can't think of how your brand ties into something visually exciting -- and if you think really hard, I bet you can figure it out ;-)

How deadly Marburg virus silences immune system: Breakthrough findings point to targets for drugs and vaccines

ScienceDaily (Sep. 13, 2012) ? Scientists at The Scripps Research Institute have determined the structure of a critical protein from the Marburg virus, a close cousin of Ebola virus. These viruses cause similar diseases and are some of the deadliest pathogens on the planet, each killing up to 90 percent of those infected.

Described in the Sept. 13, 2012 publication of the journal PLoS Pathogens, the new research reveals how a key protein component of the Marburg virus, called VP35, blocks the human immune system, allowing the virus to grow unchecked. The structure provides a major step forward in understanding how the deadly virus works, and may be useful in the development of potential treatments for those infected.

"The immune system is designed to recognize certain hallmarks of virus infection," said Erica Ollmann Saphire, the Scripps Research scientist who led the effort. "When these are sensed, an immediate antiviral defense is launched. However, the Marburg and Ebola viruses mask the evidence of their own infection. By doing so, the viruses are able to replicate rapidly and overwhelm the patient's ability to launch an effective defense."

Deadly Outbreaks

Ebola virus outbreaks have occurred in the last month in both Uganda and the Democratic Republic of the Congo, while Marburg virus broke out in Angola in 2005 to 2006 and again in Uganda in 2007. The Angolan Marburg virus outbreak began in a pediatric ward and killed 88 percent of those it infected. The virus has since been imported into the United States (Colorado) and the Netherlands by tourists who had visited Africa.

There is currently no cure for Marburg hemorrhagic fever. The virus is spread when people come into contact with the bodily fluids of a person or animal who is already infected. The best treatment consists of administering fluids and taking protective measures to ensure containment, like isolating the patient and washing sheets with bleach.

Most people, however, die within two weeks of exposure from a combination of dehydration, massive bleeding, and shock. A smaller number of people have stronger and immediate immune responses against the virus and survive.

A New Roadmap for Defense

The breakthrough described in the PLoS Pathogens article explains a key reason why the viruses are so deadly and provides the necessary templates to develop drugs to treat the infection.

The study's lead author, Research Associate Shridhar Bale, explains that a key signature of Marburg virus infection is the double-stranded RNA that results from its replication inside cells. When human immune system proteins detect this virus-specific RNA, they sound an alarm to signal the rest of the immune system to respond. The new research describes how the VP35 protein of the Marburg virus binds to the viral double-stranded RNA and hides it to prevent the alarm from being sounded.

The new research also revealed a surprise. Images from the Marburg virus reveal the VP35 protein spirals around the double-stranded RNA, enveloping it completely. This is in contrast to previous images of the similar VP35 protein from Ebola virus that showed it only capping the ends of the RNA, leaving the center of the RNA helix exposed for possible recognition.

In addition to Ollmann Saphire and Bale, the article, "Marburg virus VP35 can both fully coat the backbone and cap the ends of dsRNA for interferon antagonism," was authored by Jean-Philippe Julien, Zachary A. Bornholdt, Michelle A. Zandonatti, Gerard J.A. Kroon, Christopher R. Kimberlin, Ian J. MacRae, and Ian A. Wilson of The Scripps Research Institute, and Peter Halfmann, John Kunert, and Yoshihiro Kawaoka of the University of Wisconsin.
